1. Introduction
These Terms and Conditions govern the use of services provided by Expresar Logistics Private Limited (CIN: U52292GJ2025PTC166992), a company incorporated under the Companies Act, 2013, registered in Gujarat, India. By engaging our services, clients agree to be bound by these terms.
2. Services
Expresar Logistics provides transportation and logistics services including but not limited to Full Truck Load (FTL) transport, trailer solutions (35-ton and 42-ton), heavy cargo transportation, dedicated vehicle placement, nationwide freight movement, and supply chain management. The scope, pricing, and specific conditions of each engagement shall be defined in individual service agreements or purchase orders.
3. Bookings & Confirmation
All service bookings must be confirmed in writing via email, purchase order, or written agreement. Verbal commitments do not constitute binding contracts. Expresar Logistics reserves the right to accept or decline any booking at its discretion. Confirmed bookings are subject to vehicle availability and route feasibility.
4. Client Responsibilities
The client is responsible for: (a) providing accurate and complete information regarding the cargo, including weight, dimensions, nature of goods, and origin/destination details; (b) ensuring cargo is properly packed, labeled, and complies with applicable laws and regulations; (c) obtaining all necessary permits, licenses, or clearances for the transportation of specific goods; (d) being present or ensuring authorized representation at loading and unloading points.
5. Pricing & Payment
Service charges are agreed upon prior to execution and outlined in individual service agreements. Unless otherwise stated, invoices are payable within 15 days of service completion. Late payments may attract interest at the rate of 18% per annum. Expresar Logistics reserves the right to revise pricing with reasonable advance notice.
6. Liability & Insurance
Expresar Logistics will exercise reasonable care in handling and transporting cargo. However, we shall not be liable for losses arising from: (a) events of force majeure including natural disasters, strikes, or government actions; (b) inherent defects or inadequate packing by the client; (c) perishable goods beyond standard transit conditions; (d) cargo not declared accurately. Clients are advised to obtain appropriate cargo insurance independently. Expresar Logistics’ liability, where applicable, is limited to the freight charges paid for the specific consignment.
7. Prohibited Cargo
Expresar Logistics does not transport illegal goods, hazardous materials without prior agreement and proper documentation, live animals without appropriate arrangements, or any goods restricted under applicable Indian law. The client bears full responsibility for compliance regarding the nature of goods tendered for transport.
8. Cancellation & Modifications
Cancellations or modifications to confirmed bookings must be communicated at least 24 hours in advance. Late cancellations may incur charges to cover vehicle deployment costs. Expresar Logistics may cancel or reschedule a service due to operational, safety, or regulatory reasons with reasonable notice to the client.
9. Dispute Resolution
Any disputes arising from these terms shall first be attempted to be resolved amicably between the parties. If unresolved within 30 days, disputes shall be subject to arbitration as per the Arbitration and Conciliation Act, 1996. The jurisdiction for all legal matters shall be courts in Gujarat, India.
10. Governing Law
These Terms and Conditions are governed by the laws of India. Any changes to these terms will be notified to clients and published on our official communications. Continued engagement with our services after such notification constitutes acceptance of updated terms.
